By accessing or using AI Clothes Changer (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

AI Clothes Changer is an AI clothes changer and virtual try-on studio. You upload a person photo and a garment reference, and our system generates a new image of that person wearing the outfit. The Service is provided for personal and professional use. The Service is an independent application built on third-party image-generation models (fal). Generated images are produced by these third-party services based on the photos you upload. Generated images are machine-generated and may contain artifacts or inaccuracies. The Service is not a substitute for professional photography or retouching where exact accuracy is required.

To use certain features of the Service, you must create an account. When registering, you agree to: - Provide accurate, current, and complete information - Maintain the security of your password and account - Accept responsibility for all activities that occur under your account - Notify us immediately of any unauthorized use of your account You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

The Service operates on a credit-based system. Generating an image consumes credits: Preview mode costs 10 credits and Studio mode costs 20 credits per generation, which can return up to 4 variations at no extra cost. Pro mode costs 20 credits per generation and returns a single image generated from your styling prompt. You can buy a subscription (which grants a monthly credit allowance) or one-time credit packs. Pricing: Plan prices and credit allowances are displayed on our pricing page and may change at any time. Price changes will not affect your current subscription period. Payment Processing: Payments are processed by our payment partner Dodo. By making a purchase, you agree to its terms of service and payment processing policies. Refunds: Subscriptions and used credits are non-refundable except where required by applicable law. Plan credits granted for a period do not carry over to the next period and have no cash value; purchased credit packs do not expire. Failed Transactions: If a payment fails or is reversed (including chargebacks), we reserve the right to suspend or terminate your access to the Service.

You retain ownership of the photos you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the Service (generating images). You represent and warrant that: - You own or have the necessary rights to upload the User Content, including the rights and consent required for any people depicted in your photos - Your User Content does not violate the rights of any third party - Your User Content complies with these Terms and all applicable laws We do not claim ownership of your User Content. You may request account deletion at any time, and we will delete your uploaded photos and generated images in accordance with our Privacy Policy.

You agree not to use the Service to: - Upload photos of people without the consent required by law - Generate images from photos you do not have the right to use, including images of people created or shared without their consent where prohibited - Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable - Attempt to reverse-engineer, decompile, or extract the image-generation models or algorithms - Use automated tools, bots, or scripts to access the Service in ways that abuse or overload it - Interfere with or disrupt the Service or servers - Attempt to gain unauthorized access to any part of the Service - Use the Service in any way that could damage our reputation or the experience of other users Violation of these prohibitions may result in immediate termination of your account.

The Service, including its design, code, image-generation models, and all related content (excluding User Content), is owned by AI Clothes Changer and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its content without our express written permission. Images generated by the Service are provided to you for personal and professional use. Accounts with a paid plan or a purchased credit pack may download, share, and use their generated images, including for commercial purposes, subject to these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT - WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE - WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF AI-GENERATED RESULTS Images generated by our AI are machine-generated and may contain visual artifacts or inaccuracies. We do not guarantee that any generated image will be perfectly accurate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CLOTHES CHANGER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: - ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES - ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE - ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless AI Clothes Changer and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: - Your use of the Service - Your violation of these Terms - Your User Content - Your violation of any third-party rights

You may delete your account at any time from Profile → Danger zone → Delete account. You can also request deletion by contacting us at support@ai-clothes-changer.net. Deletion removes your profile, uploads, and generated images immediately, subject to the retention exceptions described in our Privacy Policy. We may suspend or terminate your account at any time, with or without notice, for: - Violation of these Terms - Suspected fraudulent or illegal activity - Extended periods of inactivity - Any other reason at our sole discretion Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AI Clothes Changer operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by applicable law.

The Service is operated by: AI Clothes Changer Shenzhen, China All references to "we", "us", "our", "AI Clothes Changer", and the "Company" refer to AI Clothes Changer.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
